These Terms of Use ("Terms") govern your use of the BimmerDrift iOS application and the BimmerDrift website. By downloading, accessing, or using BimmerDrift, you agree to these Terms.

If you do not agree, do not use the app or website.

1. Parties

These Terms are between you and:

2. Description of the Service

BimmerDrift is an iPhone app intended for use with supported BMW vehicles and supported adapters. The app is designed to connect to supported vehicles, display vehicle-related information, and enable certain supported app-controlled vehicle functions.

3. Eligibility

You may use the app only if:

• you are legally able to enter into these Terms;
• you comply with applicable law;
• you use a supported vehicle and supported adapter; and
• you use the app only in a manner permitted by these Terms.

4. Vehicle Compatibility

Compatibility is limited. Not all BMW vehicles, model years, configurations, software versions, adapters, or regions are supported.

Current product positioning references support for:

• BMW G Series
• BMW F Series

Compatibility may change over time.

5. Purchases and Access

The app may offer paid access through:

• a monthly subscription; and/or
• a lifetime unlock

A. Monthly subscription

The monthly subscription is an auto-renewable subscription billed by Apple through your App Store account unless canceled in accordance with Apple's subscription settings and policies.

B. Lifetime unlock

The lifetime unlock is a non-consumable in-app purchase intended to provide ongoing access to the covered app entitlement, subject to Apple's platform rules, your continued compliance with these Terms, and product availability.

C. Billing

Billing, renewals, refunds, cancellations, and payment handling are managed by Apple under Apple's systems and policies.

D. Restore

If supported by Apple for your account and purchase history, you may restore eligible purchases through the app's restore purchases function.

6. No Guarantee of Continuous Availability

We do not guarantee that the app, any feature, subscription, lifetime unlock, compatibility state, or supported function will always be available, uninterrupted, or error-free.

7. Safety and User Responsibility

You are solely responsible for all use of the app and any resulting effect on your vehicle, hardware, software, settings, behavior, or operation.

You agree that you are solely responsible for:

• verifying that your vehicle and adapter are supported
• using the app only when safe and lawful
• understanding the effect of any command you initiate
• operating, testing, and using your vehicle responsibly
• complying with all applicable laws, regulations, road rules, lease terms, financing terms, warranty terms, and insurance requirements

Do not use the app in any manner that is unsafe, distracting, unlawful, or inappropriate for the environment in which the vehicle is being operated.

8. No Automotive, Mechanical, or Legal Advice

The app and website are provided for informational and software-control purposes only. They do not provide mechanical, engineering, safety, legal, insurance, regulatory, or warranty advice.

9. Assumption of Risk

Vehicle software, diagnostic communication, and configuration-related actions involve risk. By using the app, you knowingly assume all risks associated with:

• connectivity issues
• unsupported configurations
• failed or partial commands
• error states
• vehicle behavior changes
• loss of settings or need for re-application
• hardware, software, or network issues
• damage, malfunction, or unintended vehicle outcomes

10. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APP, WEBSITE, AND ALL RELATED CONTENT AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

WE DISCLAIM ALL WARRANTIES, INCLUDING WITHOUT LIMITATION:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• COMPATIBILITY
• RELIABILITY
• ACCURACY
• AVAILABILITY
• SECURITY
• ERROR-FREE OPERATION

We do not warrant that:

• the app will work with your vehicle or adapter
• the app will always succeed in reading or writing vehicle state
• any app action will produce a particular result
• the app will remain available in any region or on any device
• subscriptions or lifetime unlocks will remain available in the same form indefinitely

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, LOSS OF VEHICLE USE, LOSS OF VALUE, LOSS OF BUSINESS, LOSS OF PROFITS, OR VEHICLE DAMAGE, ARISING OUT OF OR RELATED TO THE APP, WEBSITE, OR THESE TERMS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE APP, WEBSITE, OR THESE TERMS WILL NOT EXCEED THE GREATER OF:

• THE AMOUNT YOU PAID TO US FOR THE APP IN THE TWELVE (12) MONTHS BEFORE THE CLAIM; OR
• USD $50.

Some jurisdictions do not allow certain disclaimers or liability limitations, so parts of this section may not apply to you.

12. Prohibited Use

You agree not to:

• use the app unlawfully
• misuse, interfere with, or disrupt the app
• attempt to reverse engineer, decompile, or disassemble the app except to the extent such restriction is prohibited by law
• use the app with unsupported or unsafe hardware setups in a manner that creates unreasonable risk
• use the app to violate law, contract, regulation, or third-party rights

13. Intellectual Property

The app, website, branding, text, design, graphics, software, and related materials are owned by us or our licensors and are protected by applicable intellectual property laws.

No rights are granted except the limited right to use the app and website in accordance with these Terms.

14. Suspension or Termination

We may suspend, restrict, or terminate access to the app or website, or modify available functionality, at any time, with or without notice, to the extent permitted by law.

15. Changes to the App or Terms

We may update the app, website, features, pricing, compatibility, or these Terms at any time. Updated Terms will be posted with a revised "Last Updated" date. Continued use after an update constitutes acceptance of the updated Terms.
